The first ten of the bill of rights are called inalienable human rights for a reason. While it may have been phrased as the right to bear arms it is in essence the right to self protection. Guns are the main tool for force as of now and as a result we would need an equal measure of force to dispel attempts to infringe on our inalienable rights. Our second amendment protects all the others, that's why tyrants go for it first, but all the others also protect the second.

for what istg MUST BE the FLOPPITY TRILLIONTH TIME: Just because “inalienable” is one of the biggest words you can spell and “human rights” is one of the fanciest, legaliest terms you know does NOT mean they apply in every situation that you want them to. Like, the term HAS an actual, real definition and everything that literally preexisted, and is completely independent and unreliant, on the Bill of Rights or the Constitution.

The place where the inalienable rights of man are actually first articulated in American Jurisprudence is the Declaration of Independence (i know this is a lot to keep track of, take your time):

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.

The means and institutions through which we practice our inalienable rights are man made and man maintained. The actual rights themselves (life, liberty, and the pursuit of happiness in case you missed it) are NOT. They existed before us, and they will exist after us. They are are universal; indivisible; interdependent and interrelated; and they are applicable to every human being regardless of they live, their gender or race, or their religious, cultural or ethnic background.

Lucky for you if you want an itemized list, here are 30 actual, identified human rights explicitly listed in The Universal Declaration of Human Rights (UDHR) (what a name amirite?!?) that are classified in the articles of the UDHR. Because I’m such a peach, I’ll even copy and paste the completely publicly available and VERY GOOGLEABLE list right here:

  • Article 2 Freedom from Discrimination
  • Article 3 Right to Life, Liberty, Personal Security
  • Article 4 Freedom from Slavery
  • Article 5 Freedom from Torture and Degrading Treatment

  • Article 24 Right to Rest and Leisure
  • Article 25 Right to Adequate Living Standard
  • Article 26 Right to Education
  • Article 27 Right to Participate in the Cultural Life of Community
  • Article 28 Right to a Social Order that Articulates this Document
  • Article 29 Community Duties Essential to Free and Full Development
  • Article 30 Freedom from State or Personal Interference in the above Rights

S H O C K I N G L Y i don’t see the right to bear arms anywhere a single time on that list. Furthermore, what some people view as their “iNaLiEnAbLe hUmAn rIgHt tO oWn aN AK-47″ has now become a major threat and impediment to the practice of mankind’s ACTUAL INALIABLE HUMAN RIGHTS to liberty, safety, and most significantly, their right to life.

Instead of going around trying to “educate” other people with whatever deep political, humanitarian, philosophical insight you think you have, how about you go and educate yourself pal. I’ll even help you out with this great resource that I’m sure even you can figure out how to use... ENJOY!

you know... the really fascinating thing about the whole “DON’T LET POLITICS AFFECT YOUR RELATIONSHIPS!!!” defense is that it always seems like it’s being used by people who don’t believe gay couples should be able to get married or that poor people deserve health care, or think locking immigrant children up in cages and letting a rapist serve on the U.S. Supreme Court sound like super duper great ideas.

i just really hope that one day we as a society stop viewing rapists as “men whose lives and/or futures could be ruined” and instead see them for what they truly are: motherfuckers who ruined their own goddamn lives with out a single bit of help from anyone AND grown ass men who should pay for their crimes and be held accountable for their actions.

The 2nd Amendment is no longer the right to bear arms.  The 2nd Amendment has become the right to take lives. The 2nd Amendment is no longer aiding citizens.  The 2nd Amendment is now abetting murderers.

You know… I honestly don’t remember how did in 9th grade Social Studies?

I did okay majoring in Political Science and American Government in undergrad though. I graduated summa cum laude so I figure I must have learned something?

Law school also went alright I guess? I did somehow manage to get an article about the constitutionality and modification of excessive force laws through out the 50 states placed in a national publication. And I also managed to pass the Bar Exam. 

But yeah it’s totally possible I failed 9th grade social studies tbh. I was a little shit when I was 15 and gave no fucks.

A few things... 

1) The alleged political identifications of mass shooters are absolutely irrelevant to this conversation. The laws set forth in the Constitution apply to all Americans regardless of their political affiliations. And when the laws aren’t serving the American populace at large, then those laws need to be reevaluated and changed accordingly. I’m not sure why you think political parties are at all important here... Seriously, they have nothing to do with anything. 

2) I suggest you re-familiarize yourself with the definition of “fact,” because this is not one. 

3) While supposedly 89% of statics are made up, I am 100% sure that you are 100% full of shit.

Sooo this isn’t really correct tbh. 

See, there’s this little thing called The Incorporation Doctrine, through which selected provisions of the Bill of Rights (the first 10 Amendments) are made applicable to the states through the Due Process Clause of the 14th Amendment.

The U.S. Supreme Court has stated, first (kind of) in the holding of District of Columbia v. Heller (2008) and then (definitely) affirmed in McDonald v. Chicago (2010), that the right of an individual to "keep and bear arms" as protected under the 2nd Amendment is incorporated by the Due Process Clause against state and local governments. 

Here’s the relevant section of the McDonald opinion where Alito explicitly confirms the right of an individual to own a gun:

    Our decision in Heller points unmistakably to the answer. Self-defense is a basic right, recognized by many legal systems from ancient times to the present day, and in Heller, we held that individual self-defense is “the central component” of the Second Amendment right. 554 U. S.; see also id. (stating that the “inherent right of self-defense has been central to the Second Amendment right”). Explaining that “the need for defense of self, family, and property is most acute” in the home, ibid., we found that this right applies to handguns because they are “the most preferred firearm in the nation to ‘keep’ and use for protection of one’s home and family,” id., see also id. (noting that handguns are “overwhelmingly chosen by American society for [the] lawful purpose” of self-defense); id. (“[T]he American people have considered the handgun to be the quintessential self-defense weapon”). Thus, we concluded, citizens must be permitted “to use [handguns] for the core lawful purpose of self-defense.” Id.     Heller makes it clear that this right is “deeply rooted in this Nation’s history and tradition.” Glucksberg, supra, at 721 (internal quotation marks omitted). Heller explored the right’s origins, noting that the 1689 English Bill of Rights explicitly protected a right to keep arms for self-defense, 554 U. S., and that by 1765, Blackstone was able to assert that the right to keep and bear arms was “one of the fundamental rights of Englishmen,” id.

A vast majority of the Bill of Rights have been incorporated by the Due Process Clause, either in part or in full, as individual rights protected against the state/local governments as well as the federal government. I’ll even give you a handy dandy chart...

Ok I will say ONE THING about this debate, and that’s it...

For the love of God, WHY do people continue to fixate on the issue of The Emails™

Look, she can’t ~just release~ the freaking emails. The NSA has those emails on Fort Knox style lock down I guarantee. Do you have any idea what level of security clearance would probably be required to gain access to them?! HILLARY probably doesn’t even have the clearance required for the damn things at this point.

If she could release them I bet she would have by now no matter WHAT they said just to get everyone to stop being so gd extra about it.

On the other hand, it is COMPLETELY within Donald Trump’s power to release his tax returns. He just chooses not to.
