You’re right, intent is a given. The real problem is whether the court would believe that it constituted such egregious conduct that an average member of the community would stand and shout “outrageous!”
Based on our shared love of suffering, I do not think that is the case.
However, I too am only a law student and therefore cannot give real legal advice.
whats an oral argument
Basically, we’ve been writing a huge essay all semester about this hypothetical case (ours is an appeal from a criminal trial) and now we have to get up and argue it against an opponent in front of three judges.
I already have the substance written bc we turned in the full version a few weeks ago, but now I have to condense it into a 15 minute version which means throwing out like half of my points. It’s the worst ™
