I & … [the victim] were in the practice room one day. She & I start kissing so I started to put my hand in her pants. She said no twice before I stopped. Then we started to kiss again & this time I took her pants off & mine as well. She kept saying “no” & “stop” but I just didn’t stop. WCNC Judge Jeanine Howard publicly implied a rape victim was promiscuous and said the then 14-year-old girl was not ‘the victim she claimed to be.’ Howard has drawn further criticism for her light sentence — a five-year probation — against the rapist who admitted to the 2011 attack.
Advocates for sexual assault victims are furious with a Texas judge who said a raped 14-year-old “wasn’t the victim she claimed to be,” even after her attacker admitted to the crime.
Jeanine Howard, a Dallas County district judge, has drawn further criticism for her light sentence last week — a five-year probation — against the rapist in the 2011 assault.
The now 20-year-old Sir Young will be labeled a sex offender for life, but Howard did not issue standard sex offender restrictions, such as ordering him to refrain from pornography or undergoing sex offender treatment, the Dallas Morning News reported.
Howard removed herself from the case Friday, and a new judge has taken over.
Young admitted to raping the girl in a music room at Booker T. Washington High School for the Performing and Visual Arts on Oct. 4, 2011. He faced a maximum sentence of 20 years in prison.
Dallas County Police Sir Young pled guilty to raping a 14-year-old girl in 2011. The judge in his case sentenced him to a 5-year probation. He faced a maximum sentence of 20 years in jail.
Howard told the newspaper Young “is not your typical sex offender” and his 14-year old victim “wasn’t the victim she claimed to be.”
She implied the girl had been promiscuous and said she based her decision partially on medical records that showed the victim had three sexual partners and had given birth to a baby.
The victim, now 17, told WFAA she has never been pregnant.
"And three partners? I don’t even know where she got this. I feel like this was her way of trying to make herself feel better," she told the TV station.
WCNC The 2011 assault happened in a music practice room at Booker T. Washington High School where both Young and the victim were students. In his confession, Young, then 18, wrote that his 14-year-old victim said “no” during the attack.
Howard said other factors contributed to her decision, too. She said the girl agreed to have sex with Young, just not at school.
According to Young’s confession, the victim said “no” and “stop” as he took off her pants. She continued to say “no” during the attack.
"It was a slap in the face," she told WFAA. “I thought I was going to get help. I thought that it would be taken care of, and I wouldn’t have to worry about it anymore.”
Under his probation conditions, Young will spend 45 days in jail. For the next five years, he’ll also spend the anniversary of the rape in prison.
Young’s sentence initially included 250 hours of community service at a rape crisis center, but the local Dallas center said he is not welcome.
Howard told the Dallas Morning News she never wanted Young to work directly with rape victims and thought he could help clean the building. There’s no word on where Young will carry out his community service.
"This is an example of why people don’t come forward and report their sexual assaults because they are not only victimized at the time but the continuing game of shame and blame," Bobby Villareal, executive director of the Dallas Area Rape Crisis Center, told WFAA.
Prosecutors have filed a motion seeking the terms of Young’s probation be reconsidered.
So not only do you get off with no jail time, the judge actually sentenced you to volunteer at a rape crisis center? Like what the actual fuck kind of sense does that make? What does someone’s virginity have to do with whether or not they are a rape victim or not? IT DOESN’T. This whole ignorant notion on what a rape victim should look like or be like is ridiculous. This is what a rape victim looks like. They look like everyone else. They look like your mother your father your sister and brother. A rape victim is the cop who works the late night shift; they are the soldiers who wear the uniforms. A rape victim looks like the teacher standing up in the front of the class talking to your children. Sometimes a rape victim even looks like the person standing in the mirror. There is no one particular look, attitude or specific behavior of a rape victim. That ideology is false and only reinforces the stereotype that the rapist is only a man hiding behind the bushes while you’re walking home late at night.
The victim is 14 years old. The age of consent ranges from 16 to 18 in the United States depending on the state you live in. In Texas the age of consent is 17 years old. Texas does not have an age gap provision (where you can be a certain amount of years apart and still not be prosecuted for consensual sex as long as your partner is of consenting age) or a mistaken age defense. The victim was 14 at the time of the RAPE. He was 18. She was nowhere near the age of consent and he was an adult. So because Texas doesn’t have the age gap provision this would be statutory rape under the circumstances. Here’s the thing. He confessed to raping her. In his statement he talks about how the victim said no and stop multiple times (not saying no or stop DOES NOT MEAN YOU WERENT RAPED) but he kept going. He then says how he couldn’t believe what he had just done and was scared when she started bleeding because he thought he “stolen her virginity” and told her to keep it between the two of them.
He confessed to raping her and yet the judge feels he doesn’t deserve jail time. That it doesn’t solve anything. And gives him volunteering at a rape crisis center? Because that’s the right thing to do. Make a rapist volunteer with rape survivors. That fixes everything doesn’t it?
If only 2% of rapist ever serve time in jail how the fuck do we know if it working or not? 2%? In jail…..so it’s okay to give the rapist a break so they don’t serve time in jail and ruin their lives, mean while the victim is being called all types of names and will have to suffer for the rest of their life? So were getting to the point in life where we are letting rapist walk free now because the 2% we send to jail are not gaining experience from it.
This is just complete and utter bullshit
