Hello! I come with some good news! In the EU, a law has been passed restricting generative AIs (particularly ones that pose a high risk). I hope other areas in the world follow suit, but this is huge! It'll take a while to be applied as well, though this is still a major win for everyone.

What this new law means...

AI will be banned from being used for the following purposes:

'Biometric categorisation systems' using sensitive information scraped from images on the internet and CCTV footage.' This means people can't use AI/scraping to create a catalogue for;

  • facial recognition databases.
  • 'Emotion recognition' in schools and workplaces
  • Social scoring systems
  • Predictive Policing
  • Being designed to manipulate human behaviour

People will gain the right to file complaints regarding AI systems.

AI developers must minimize risk to people, maintain usage logs, ensure transparency, and implement human oversight.

AI models will have to comply with EU copyright law

This means AI devs will HAVE to provide a comprehensive and detailed summary of the data used to train their AI's.

Any AI generated video, image, or audio (including deepfakes) MUST be labelled as such.

This is not in force for at LEAST two years. However it *is* going to become law (with an overwhelming majority of the European Parliament voting in favour, 523 in favour, 46 against, 49 absent.)

This is the first what is likely to be a slew of laws and regulations regarding the usage of AI.

So unfortunately OP seems to have misinterpreted supporting evidence for the legal argument as being the legal argument itself. Let me explain.

The problem (what's being sued over) isn't that ChatGPT can spit out derivative work, it's why it can spit out derivative work.

Ground rule fact that must be understood: it is impossible for anything produced by ChatGTP to be original content. It does not "learn" it can only "copy".

And what's it called when you copy someone's work? Plagiarism.

We've all been saying it. Everyone knows it. But if you're suing then you have to prove it. So what is the evidence? The quote above.

The plaintifs are arguing that if ChatGPT hadn't been fed (in this instance) the various copyrighted works of George RR Martin, then it wouldn't be possible for it to produce canon-accurate and/or "detailed" outlines using "the same characters from existing books".

In other words, if ChatGPT didn't have all the plots/nouns/names/etc from A Song of Ice and Fire loaded into it—which is only possible by being fed books that it doesn't legally have access to!—then it wouldn't be able to spit anything related to that topic back out.

The second part, which should make fanfic authors feel even better, is that the only reason any of this is going anywhere is because

It's already been established that fanfic isn't "protected" if money is changing hands. The fact that fanfic is free is why it's safe.

Meanwhile, this whole issue is being brought to court, because of money.

The authors couldn't be arguing to have lost anything and couldn't win anything if there wasn't money involved—meaning that they couldn't have even brought the issue to court and made an argument in court that ChatGPT needs to be taken down if they couldn't prove they were robbed of something.

What should fanfic authors feel even even better is that

the whole point is to show how "afab" being used as a replacement for woman is fucking stupid and fundamentally incorrect and. whatever else. and it gives me hope to see the community rising up like this. solidarity and unity and peace on planet earth.

You know what’s more fun than worldbuilding that makes some fantasy races EEEEVIIIIIIILLLLL!!!!? Worldbuilding that gives the different races cultural differences that help explain why there’s a lot of conflict between them:

Goblin culture doesn’t have a concept of “Property”. A stick on the ground and a tool in a locked shed are equally up for grabs if a thing needs doing. They casually take and leave things all over their communities, eat from communal pots, and genuinely Do Not Understand why the Core Races are so Angry and prone to Violence all the time.

Consequently Goblins who live near Core communities develop a reputation as “Thieves” despite not even having a *word* for that. (The closest word they have is more like “Greedy” and it means a person that hides things so nobody else can use them, and it’s a surefire fight-starter to call a Goblin that)

Common Orc Spiritual beliefs hold that a Soul can only grow stronger by overcoming Challenges in life, and see intruding on another person’s Challenge unasked for as not just Rude, but Deeply Harmful. You’re Stealing their chance to Grow. Asking for help is deeply personal and doing so can be both a way to grow closer with them or a too-personal intrusion, depending on your existing relationship with them. An exception is Children, as far as most Orcs are concerned, all Children are fundamentally the responsibility of the Whole Community, regardless of whose child they are, or even if said child is an Orc at *all*.

This means that Orcs who live near Core neighbors often seem Rude and Standoffish if not outright hostile, because they neither ask for nor offer aid even in times of trouble, and respond to unasked for aid themselves with Anger. There are even rumors that they Steal Children, because if an Orc finds a child lost in the woods they’re pretty much immediately going to start feeding it, and if they can’t find where to bring it back to, or it doesn’t seem to be well cared for, they’re just gonna keep it.
